In the state of Vermont, the personal representative of the deceased is the one who brings forth wrongful death actions against the responsible party. If the deceased had not named a personal representative, the court is able to appoint one. Damages awarded by the court are then distributed to the decedent's surviving kin, with exceptions.

The Statute of Limitations in Vermont

If a criminal case was filed on similar facts, the claim must be filed within two years of the conviction. In all other situations, the claim must be filed within two years of the death.
